avanc\u00e9e majeure pour les salari\u00e9s<\/b><\/h3><p><span style=\"font-weight: 400;\">Le 21 mars 2024, la <\/span><b>Cour de cassation<\/b><span style=\"font-weight: 400;\"> a rendu un arr\u00eat d\u00e9cisif en mati\u00e8re de <\/span><b>t\u00e9l\u00e9travail<\/b><span style=\"font-weight: 400;\">. Elle reconna\u00eet d\u00e9sormais qu\u2019un salari\u00e9 utilisant son <\/span><b>domicile \u00e0 des fins professionnelles<\/b><span style=\"font-weight: 400;\"> peut r\u00e9clamer une <\/span><b>indemnit\u00e9 d\u2019occupation<\/b><span style=\"font-weight: 400;\">, m\u00eame si cette question n\u2019\u00e9tait pas le c\u0153ur du litige initial.<\/span><\/p><p><span style=\"font-weight: 400;\">Ce raisonnement repose sur un principe fondamental : <\/span><b>l\u2019usage du domicile priv\u00e9 constitue une immixtion dans la vie priv\u00e9e<\/b><span style=\"font-weight: 400;\"> du salari\u00e9. Or, toute atteinte \u00e0 la sph\u00e8re personnelle doit donner lieu \u00e0 une contrepartie financi\u00e8re.<br \/><br \/><\/span><\/p><h3><b>Une nouvelle lecture des obligations de l\u2019employeur<\/b><\/h3><p><span style=\"font-weight: 400;\">La Cour pr\u00e9cise que cette indemnit\u00e9 est due lorsque :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Aucun <\/span><b>local professionnel<\/b><span style=\"font-weight: 400;\"> n\u2019est mis \u00e0 disposition ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ou que le <\/span><b>t\u00e9l\u00e9travail est pr\u00e9vu contractuellement<\/b><span style=\"font-weight: 400;\"> (contrat, avenant ou accord collectif).<br \/><br \/><\/span><\/li><\/ul><p><i><span style=\"font-weight: 400;\">\u00ab L\u2019occupation du domicile du salari\u00e9 \u00e0 des fins professionnelles constitue une immixtion dans sa vie priv\u00e9e, de sorte qu\u2019il peut pr\u00e9tendre \u00e0 une indemnit\u00e9 \u00e0 ce titre d\u00e8s lors qu\u2019un local professionnel n\u2019est pas mis effectivement \u00e0 sa disposition ou qu\u2019il a \u00e9t\u00e9 convenu que le travail s\u2019effectue sous la forme du t\u00e9l\u00e9travail. \u00bb<\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><span style=\"font-weight: 400;\"> \u2014 Cour de cassation, 21 mars 2024<br \/><br \/><\/span><\/p><h2><b>Indemnit\u00e9 d\u2019occupation en t\u00e9l\u00e9travail : vers un droit automatique<\/b><\/h2><p><span style=\"font-weight: 400;\">Cet arr\u00eat bouleverse les pratiques. Jusque-l\u00e0, seules certaines situations donnaient droit \u00e0 indemnisation : <\/span><b>clause sp\u00e9cifique dans le contrat<\/b><span style=\"font-weight: 400;\">, <\/span><b>usage \u00e9tabli<\/b><span style=\"font-weight: 400;\">, ou <\/span><b>justificatifs de frais<\/b><span style=\"font-weight: 400;\"> (Internet, mobilier, chauffage&#8230;).<\/span><\/p><p><span style=\"font-weight: 400;\">Ce n\u2019est d\u00e9sormais <\/span><b>plus n\u00e9cessaire<\/b><span style=\"font-weight: 400;\">. Le <\/span><b>simple usage du domicile<\/b><span style=\"font-weight: 400;\"> dans le cadre professionnel suffit \u00e0 faire na\u00eetre ce droit. Il ne s\u2019agit plus seulement d\u2019un <\/span><b>remboursement de frais<\/b><span style=\"font-weight: 400;\">, mais d\u2019une <\/span><b>compensation li\u00e9e \u00e0 la privatisation de l\u2019espace personnel<\/b><span style=\"font-weight: 400;\"> du salari\u00e9.<\/span><\/p><p><span style=\"font-weight: 400;\">\ud83d\udc49 Ce glissement \u00e9largit consid\u00e9rablement la notion de pr\u00e9judice, en consid\u00e9rant l\u2019<\/span><b>impact du t\u00e9l\u00e9travail sur la vie priv\u00e9e<\/b><span style=\"font-weight: 400;\"> comme une charge \u00e0 compenser.<br \/><br \/><\/span><\/p><h2><b>Obligations des entreprises : int\u00e9grer l\u2019indemnit\u00e9 t\u00e9l\u00e9travail dans les pratiques RH<\/b><\/h2><p><span style=\"font-weight: 400;\">Les employeurs doivent d\u00e9sormais int\u00e9grer cette nouvelle donne dans leur gestion du t\u00e9l\u00e9travail.
