Cette \u00e9volution est encourageante. Pourtant, l\u2019alcool reste un facteur majeur de risque en entreprise. Il impacte directement la s\u00e9curit\u00e9, la sant\u00e9 des salari\u00e9s et la responsabilit\u00e9 de l\u2019employeur.<\/span><\/p><p><span style=\"font-weight: 400;\">Anticiper ce risque n\u2019est plus une option. C\u2019est une obligation r\u00e9glementaire et un enjeu essentiel de pr\u00e9vention.<\/span><\/p><p><span style=\"font-weight: 400;\">Comme le rappelle cet article de BAPE sur la gestion des risques, une organisation solide repose sur sa capacit\u00e9 \u00e0 anticiper les situations \u00e0 risque et \u00e0 agir avec lucidit\u00e9 plut\u00f4t que subir les cons\u00e9quences.<\/span><\/p><p><span style=\"font-weight: 400;\">\ud83d\udc49 \u00c0 lire \u00e9galement :\u00a0<\/span><a href=\"https:\/\/dev.baptiste-crestey.fr\/bape\/gestion-des-risques-renforcer-la-confiance\/\"><span style=\"font-weight: 400;\">BAPE &#8211; Gestion des risques : renforcer la confiance sans c\u00e9der \u00e0 la peur<\/span><\/a><\/p><p>\u00a0<\/p><h2><b>Alcool et accidents du travail : un risque professionnel encore sous-estim\u00e9<\/b><\/h2><p><span style=\"font-weight: 400;\">L\u2019alcool alt\u00e8re les capacit\u00e9s physiques et mentales. Il r\u00e9duit la vigilance, ralentit les r\u00e9flexes et perturbe la prise de d\u00e9cision. Ces effets augmentent fortement le risque d\u2019accident.<\/span><\/p><p><span style=\"font-weight: 400;\">Selon une expertise de INSERM, plus de 10 % des accidents du travail seraient li\u00e9s \u00e0 la consommation d\u2019alcool.<\/span><\/p><p><span style=\"font-weight: 400;\">Les cons\u00e9quences peuvent \u00eatre graves :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">accidents corporels,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">erreurs professionnelles,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">mise en danger d\u2019autrui,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dommages mat\u00e9riels.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\"><br \/>\u00c0 long terme, les impacts sur la sant\u00e9 sont \u00e9galement importants : cancers, troubles cognitifs ou d\u00e9pendance. Ces risques concernent tous les secteurs d\u2019activit\u00e9.<\/span><\/p><p><span style=\"font-weight: 400;\">La pr\u00e9vention du risque alcool doit donc \u00eatre int\u00e9gr\u00e9e pleinement dans la politique de s\u00e9curit\u00e9 de l\u2019entreprise.<\/span><\/p><p>\u00a0<\/p><h2><b>Ce que dit le Code du travail sur l\u2019alcool en entreprise<\/b><\/h2><p><span style=\"font-weight: 400;\">La r\u00e9glementation est claire. Le Code du travail encadre strictement la consommation d\u2019alcool sur le lieu de travail.<\/span><\/p><p><span style=\"font-weight: 400;\">L\u2019article R4228-20 autorise uniquement :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le vin,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">la bi\u00e8re,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le cidre,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le poir\u00e9.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\"><br \/>Toute autre boisson alcoolis\u00e9e est interdite.<\/span><\/p><p><span style=\"font-weight: 400;\">L\u2019article R4228-21 interdit formellement la pr\u00e9sence d\u2019une personne en \u00e9tat d\u2019ivresse dans l\u2019entreprise.<\/span><\/p><p><span style=\"font-weight: 400;\">Depuis 2014, l\u2019employeur peut aller plus loin. Il peut interdire totalement l\u2019alcool via le r\u00e8glement int\u00e9rieur ou une note de service, si cela est justifi\u00e9 par la s\u00e9curit\u00e9.<\/span><\/p><p><span style=\"font-weight: 400;\">Vous pouvez consulter le texte officiel sur le site de <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000018531956\"><span style=\"font-weight: 400;\">L\u00e9gifrance<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Cette mesure est particuli\u00e8rement recommand\u00e9e pour les postes \u00e0 risque : conduite, manutention, machines, travail en hauteur ou manipulation de produits dangereux.<\/span><\/p><p>\u00a0<\/p><h2><b>Responsabilit\u00e9 de l\u2019employeur : un risque juridique r\u00e9el<\/b><\/h2><p><span style=\"font-weight: 400;\">L\u2019employeur est tenu \u00e0 une obligation de s\u00e9curit\u00e9 envers ses salari\u00e9s. Cette obligation s\u2019applique en permanence.<\/span><\/p><p><span style=\"font-weight: 400;\">Elle concerne notamment :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le lieu de travail,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les d\u00e9placements professionnels,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les \u00e9v\u00e9nements organis\u00e9s par l\u2019entreprise,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les soir\u00e9es et moments conviviaux.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\"><br \/>M\u00eame lors d\u2019un \u00e9v\u00e9nement festif, le cadre reste professionnel. La responsabilit\u00e9 de l\u2019employeur peut \u00eatre engag\u00e9e en cas d\u2019accident.<\/span><\/p><p><span style=\"font-weight: 400;\">Si aucune mesure de pr\u00e9vention n\u2019a \u00e9t\u00e9 mise en place, l\u2019employeur s\u2019expose \u00e0 des cons\u00e9quences potentielles lourdes :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">reconnaissance d\u2019un accident du travail,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">reconnaissance d\u2019une faute inexcusable<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">engagement de sa responsabilit\u00e9 p\u00e9nale<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">sanctions financi\u00e8res importantes.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\"><br \/>La simple tol\u00e9rance d\u2019alcool peut suffire \u00e0 engager la responsabilit\u00e9 de l\u2019entreprise.<\/span><\/p><p>\u00a0<\/p><h2><b>\u00c9v\u00e9nements professionnels : un moment convivial mais encadr\u00e9<\/b><\/h2><p><span style=\"font-weight: 400;\">Les pots d\u2019entreprise, s\u00e9minaires ou \u00e9v\u00e9nements internes sont fr\u00e9quents. Ils participent \u00e0 la coh\u00e9sion des \u00e9quipes.<\/span><\/p><p><span style=\"font-weight: 400;\">Mais ils doivent \u00eatre encadr\u00e9s.<\/span><\/p><p><span style=\"font-weight: 400;\">L\u2019employeur doit mettre en place des mesures de pr\u00e9vention adapt\u00e9es :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">d\u00e9finir des r\u00e8gles claires,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">limiter ou interdire l\u2019alcool,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">proposer des alternatives sans alcool,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">pr\u00e9voir des solutions de retour s\u00e9curis\u00e9es si n\u00e9cessaire.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\"><br \/>La convivialit\u00e9 ne doit jamais compromettre la s\u00e9curit\u00e9.<\/span><\/p><p><span style=\"font-weight: 400;\">Pour aller plus loin \u27a1\ufe0f <a href=\"https:\/\/www.inrs.fr\/publications\/juridique\/focus-juridiques\/focus-pots-entreprise-alcool.html\" target=\"_blank\" rel=\"noopener\">INRS &#8211; Pots d\u2019entreprise et alcool : quelles sont les r\u00e8gles applicables ?<\/a><\/span><\/p><p>\u00a0<\/p><h2><b>Pr\u00e9vention du risque alcool : une d\u00e9marche obligatoire<\/b><\/h2><p><span style=\"font-weight: 400;\">La pr\u00e9vention repose sur trois piliers essentiels :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Informer les salari\u00e9s sur les effets et les risques de l\u2019alcool. La sensibilisation permet de r\u00e9duire les comportements \u00e0 risque.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Former les encadrants. Ils doivent \u00eatre capables d\u2019identifier les situations sensibles et d\u2019agir rapidement.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Orienter les salari\u00e9s concern\u00e9s vers les bons interlocuteurs, notamment la m\u00e9decine du travail.
